Not Guilty Plea and Trial Request

Entering a Not Guilty Plea

A plea of Not Guilty means that you deny the allegations contained in the citation and require the State to prove its case against you in court.

When you enter a Not Guilty plea, your case will be scheduled for trial. You have the right to choose either:

  • A Bench Trial (trial before the Judge), or
  • A Jury Trial (trial before a jury of your peers).

You may choose to hire an attorney to represent you at trial. You also have the right to represent yourself; however, no person other than a licensed attorney may represent you in court.

Important Notice

Once you enter a plea of Not Guilty, you waive your right to request dismissal through a Driver Safety Course (Defensive Driving) for that citation.

Your Rights as a Defendant

As a defendant in Municipal Court, you have important constitutional and statutory rights, including:

Your Rights During Trial

During your trial, you have the right to:

  • Hear all testimony and evidence presented against you.
  • Cross-examine witnesses who testify against you.

  • Require the State to prove its case beyond a reasonable doubt.

Deferred Disposition / Probation

Deferred Disposition Information

If your request for Deferred Disposition is granted, you will be placed on a probation period not to exceed 180 days. During this time, you must comply with all terms and conditions ordered by the Court.

Probation Conditions

As a condition of probation:

  • You must not receive any additional citations anywhere in the United States, including parking violations.
  • Additional conditions may be imposed by the Court.
  • All requirements will be provided to you in writing.
  • You must read and sign the Deferred Disposition Order.
  • Defendants under age 25 must complete a State-approved Defensive Driving Course.

Eligibility Requirements

You may qualify if:

  • You enter a plea of No Contest (Nolo Contendere).
  • You do not possess a Commercial Driver License (CDL).
  • You have not completed Deferred Disposition within the previous 12 months.
  • Your speeding violation is less than 25 mph over the posted speed limit.
  • The offense did not occur in a construction zone.
  • The citation has not already been paid.

Ineligible Offenses

You are not eligible if:

  • The citation involved an accident.
  • Witnesses were present during the offense.
  • You have been on probation within the last 12 months.
  • Speed exceeded 24 mph over the posted speed limit.
  • The offense involved passing a school bus.
  • The offense occurred in a construction zone with workers present.
  • The citation is for a non-traffic offense.
  • You hold a Commercial Driver License.

How to Apply

Requests must be:

  • Submitted in person, or
  • Submitted by mail

and received within 12 calendar days of the offense date.

Important Notice

Failure to comply with all terms of Deferred Disposition may result in a conviction being entered and probation being revoked.

Defensive Driving

Defensive Driving Eligibility Requirements

The Jasper Municipal Court allows eligible defendants to request the option of Defensive Driving to dismiss certain moving violations. To qualify, you must meet all eligibility requirements and comply with all instructions provided by the Court.

You May Be Eligible for Defensive Driving If:

  • You have entered a plea of Guilty or No Contest (Nolo Contendere) and submitted your request for Defensive Driving on or before the appearance date listed on your citation.
  • You possess a valid, non-commercial Texas driver's license (not a Commercial Driver License).
  • You provide proof of current automobile liability insurance showing you as a covered driver.
  • You have not completed a Defensive Driving course for ticket dismissal within the previous 12 months, calculated from the date of your previous dismissal to the date of your current citation.
  • Your citation is for an eligible moving violation under Texas law.
  • You were not cited for speeding 25 mph or more over the posted speed limit.
  • You have not already paid the fine, resulting in a final conviction.

You Are NOT Eligible for Defensive Driving If:

  • You hold a Commercial Driver License (CDL).
  • You were charged with speeding 25 mph or more above the posted speed limit.
  • Your citation involved an accident, property damage, or personal injury.
  • The violation occurred in a construction zone with workers present.
  • You were cited for passing a stopped school bus.
  • You were charged with failure to stop and give information, failure to remain at the scene of an accident, or another offense not eligible under Texas law.
  • You have completed a Defensive Driving course for ticket dismissal within the previous 12 months.
  • Your citation is for a non-traffic offense such as code enforcement, animal control, or other city ordinance violations.

How to Request Defensive Driving

If you meet all eligibility requirements, you must submit your request:

  • In person at the Jasper Municipal Court Clerk's Office, or
  • By any other method approved by the Court,

on or before the appearance date shown on your citation.

Once approved, you will receive instructions regarding:

  • Payment of the required court costs and administrative fee;
  • Completion of a State-approved Defensive Driving Course; and
  • Submission deadlines for all required documentation.

In most cases, you will be given approximately 90 days to complete the course and return your Certificate of Completion and any other required documents to the Court.

Important Notice

Failure to meet all eligibility requirements or failure to submit the required documents by the deadline may result in:

  • Denial of your request;
  • Entry of a final conviction on your record; and
  • Additional court action as permitted by law.

All payments made to the Court are final and non-refundable.

Continuance Requests

Requesting a Continuance

If you are unable to appear for your scheduled court date, you may request a continuance from the Court. All continuance requests must be submitted in writing and received by the Court prior to your scheduled appearance date.

Your written request must include:

  • Your full name

  • Date of birth

  • Citation number or case number

  • The reason for requesting the continuance

  • Current mailing address

  • Current telephone number

  • Current email address (if available)

Requests may be submitted:

  • In person at the Jasper Municipal Court Clerk's Office

  • By mail

  • By email to the Court Clerk's Office

Important Notice

Telephone requests for continuances will not be accepted.

Submission of a continuance request does not automatically mean the request has been approved. You remain responsible for appearing in court unless you receive notice that your continuance has been granted.

Continuance Policy

Unless you are represented by an attorney, only one continuance will generally be granted, subject to the Judge's approval and discretion.

The Judge may deny a request if:

  • Insufficient cause is shown;

  • The request is incomplete;

  • The request is received after the scheduled court date; or

  • The Court determines that a continuance is not warranted.

If your request is approved, the Court will provide written notice of your new court date.

Attorney Representation

If you are represented by an attorney, your attorney must file a formal written Motion for Continuance with the Court.

All motions filed by an attorney must:

  • Be submitted before the scheduled court date;

  • Comply with the Texas Rules of Criminal Procedure; and

  • State the legal basis for the requested continuance.

The granting of any attorney-filed motion remains within the discretion of the Judge.

Failure to Appear

If you fail to appear for your scheduled court date and have not been granted a continuance:

  • A Failure to Appear charge may be filed;

  • A warrant may be issued for your arrest;

  • Additional court costs and fees may be assessed; and

  • Further legal action may be taken as authorized by law.

Indigency Determination

Requesting an Indigency Determination

The Jasper Municipal Court understands that financial hardships can make it difficult for some individuals to pay fines, fees, and court costs. If you are unable to pay due to financial hardship, you may request an indigency determination and have your case reviewed by the Judge.

What Does "Indigent" Mean?

An individual may be considered indigent if they do not have sufficient income or financial resources to pay court fines and costs without causing substantial hardship to themselves or their dependents.

Each request is reviewed individually based on the person's financial circumstances and supporting documentation.

How to Request an Indigency Hearing

If you are unable to pay your citation in full, you must contact the Jasper Municipal Court to request a hearing before the Judge.

Requests may be submitted:

  • In person at the Jasper Municipal Court Clerk's Office; or
  • By mail with a written request for an indigency hearing.

Once your request is received, the Court will provide you with information regarding your hearing date and any required documentation.

What to Bring to Your Hearing

You should be prepared to explain your financial situation and provide supporting documentation. The Court may request:

  • Recent pay stubs or proof of income
  • Unemployment benefit statements
  • Disability benefit statements
  • Rent or mortgage information
  • Utility bills and other household expenses
  • Documentation of dependents
  • Childcare expenses
  • Bank statements
  • Any other documentation demonstrating your current financial condition

Failure to provide sufficient information may result in the denial of your indigency request.

Possible Alternatives

If the Court determines that you are indigent, the Judge may authorize one or more alternatives, including:

Payment Plan

A structured payment schedule with smaller monthly installments.

Extension of Time to Pay

Additional time to satisfy the balance owed.

Community Service

Community service hours performed in lieu of payment, when authorized by law.

All indigency determinations are made on a case-by-case basis and remain within the discretion of the Court.

Important Notice

Requesting an indigency hearing does not automatically excuse payment of fines and costs. You are required to appear as directed by the Court and provide truthful and complete financial information.

Failure to appear for a scheduled hearing may result in additional court action.

Community Service

Community Service Options

The Jasper Municipal Court recognizes that some individuals may be unable to pay fines and court costs due to financial hardship. In certain circumstances, the Judge may authorize community service in lieu of payment for all or a portion of the amount owed.

What Is Community Service?

Community service allows eligible individuals to satisfy court-ordered fines and costs by volunteering their time at approved non-profit, charitable, or governmental organizations.

Hours completed will be credited toward the amount owed at a rate established by the Court and in accordance with applicable Texas law.

Eligibility for Community Service

You may be eligible for community service if:

  • You are unable to pay your fine and court costs due to financial hardship.
  • You have requested and attended a hearing before the Judge.
  • You are willing and physically able to perform volunteer work.
  • The Judge determines that community service is an appropriate option for your case.

Community service is not automatically granted and is subject to approval by the Court.

Approved Community Service Locations

Community service must be completed only at organizations approved by the Jasper Municipal Court.

Examples of approved organizations may include:

  • City departments
  • County departments
  • Government agencies
  • Non-profit organizations
  • Charitable organizations

The Court Clerk will provide instructions and a list of approved organizations if community service is authorized.

Community service performed without prior Court approval may not be credited toward your obligation.

Documentation Requirements

You are responsible for ensuring that proof of completed community service is submitted to the Court by the required deadline.

Documentation must include:

  • Name of the organization
  • Dates of service
  • Total number of hours completed
  • Signature of the supervising representative
  • Contact information for verification purposes

The Court reserves the right to verify all submitted documentation.

Important Information

  • Community service hours must be completed by the deadline ordered by the Judge.
  • Community service performed at unapproved locations may not be accepted.
  • Handwritten, altered, incomplete, or unverifiable records may be rejected.
  • Failure to submit documentation by the deadline may result in additional court action.
  • If you are physically unable to perform community service, you may be required to provide medical documentation for review by the Court.
  • Once approved, all community service agreements must be completed as ordered by the Judge.

Failure to Comply

Failure to complete community service as ordered may result in:

  • Revocation of the community service agreement
  • Reinstatement of fines and court costs
  • Additional penalties authorized by law
  • Issuance of a warrant or other court action

Safe Harbor Initiative

The Jasper Municipal Court participates in a Safe Harbor Initiative.

Individuals with outstanding warrants may voluntarily come to Court to resolve their matters without fear of arrest while addressing their cases.

Our goal is to assist residents in resolving cases fairly, respectfully, and in compliance with the law.

30-Day Payment Extension

Requesting a 30-Day Payment Extension

The Jasper Municipal Court understands that unexpected financial hardships may prevent individuals from making timely payments on fines and court costs. In limited circumstances, the Court may grant a one-time 30-day payment extension.

A 30-day extension provides additional time to make a full payment or bring your account current, as approved by the Court.

Eligibility for a 30-Day Extension

You may be eligible for a 30-day payment extension if:

  • You have an active balance with the Jasper Municipal Court

  • You are experiencing a temporary financial hardship

  • You have not previously been granted multiple extensions on the same case (subject to Judge discretion)

  • Your case is not currently in warrant status (unless otherwise approved by the Court)

All extension requests are reviewed on a case-by-case basis.

How to Request a 30-Day Extension

A request for a 30-day payment extension must be submitted:

  • In person at the Jasper Municipal Court Clerk’s Office, or

  • By mail with a written request including your name, citation number, and reason for the request

Requests should be submitted as soon as possible. Approval is not guaranteed.

  • Current mailing address

  • Brief explanation of financial hardship

Court Review Process

All requests are subject to approval by the Judge or authorized Court personnel.

If approved:

  • You will receive written confirmation of the extension

  • A new due date will be established (typically 30 additional days)

  • You must comply with the new payment deadline to remain in good standing

If denied:

  • Your original due date remains in effect

  • Additional enforcement actions may proceed if the balance remains unpaid

Important Information

  • A 30-day extension does not reduce the amount owed

  • Interest, fees, or penalties (if applicable) may continue to apply

  • Failure to pay by the extended due date may result in additional penalties, including warrant issuance

  • Extensions are a privilege granted at the discretion of the Court and are not guaranteed

Payment Plans

Requesting a Payment Plan

The Jasper Municipal Court understands that paying fines and court costs in full may create a financial hardship for some individuals. If you are unable to pay the total amount due at one time, you may request a payment plan that allows you to make smaller, scheduled payments over time.

How to Request a Payment Plan

A request for a payment plan may be submitted:

  • In person at the Jasper Municipal Court Clerk's Office; or
  • By mail with a written request that includes your name, contact information, and citation number.

All payment plans must be approved by the Judge or authorized Court personnel.

Once approved, you will receive a Payment Agreement outlining:

  • Your payment schedule
  • Due dates
  • Total amount owed
  • Terms and conditions of the agreement

The agreement must be signed and returned to the Court before the payment plan becomes effective.

The Court offers several payment schedule options to help accommodate individual financial situations.

Weekly Payments

Payments are due every seven (7) days.

Bi-Weekly Payments

Payments are due every fourteen (14) days.

Semi-Monthly Payments

Payments are due twice each month, such as on the 1st and 15th.

Payments are due once per month.

Collection Agency

Court Collections

The Jasper Municipal Court utilizes Linebarger Goggan Blair & Sampson, LLP to assist with the collection of delinquent fines, fees, court costs, and judgments that have been referred for collection.

If your case has been referred to the collection agency, you must contact the collection agency directly regarding account balances, or other collection-related matters.

Why Was My Case Sent to Collections?

Cases may be referred to the collection agency when:

  • Court-ordered fines, fees, or costs remain unpaid;
  • A payment agreement has defaulted;
  • Court notices have not been responded to; or
  • The Court has determined that collection efforts should be pursued in accordance with Texas law.

Additional collection fees may be added to accounts that have been referred for collection as authorized by law.
